Terms of Service

1. Acceptance of Terms

By creating an account or using Compete With Me (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

These Terms apply to all users of the Service, including the web app at competewithme.io and the Compete With Me iOS and Android apps. We may update these Terms from time to time; your continued use of the Service after updates are posted means you accept the revised Terms.

2. Description of the Service

Compete With Me is a free platform that lets you create private competitions with friends and track measurable goals. Core features include:

• Creating and joining private competitions around any measurable metric
• Logging progress with photo proof submissions
• Head-to-head face-offs and leaderboard rankings
• Medal awards (Gold, Silver, Bronze) based on progress
• Solo metric tracking independent of competitions

The Service is provided free of charge. There are no premium tiers, paid features, or in-app purchases.

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you confirm that you have the legal capacity to enter into a binding agreement.

4. Your Account

You sign in using your Google or Apple account (or another provider we may support from time to time). You are responsible for maintaining the security of your linked account and for all activity that occurs through your Compete With Me account.

You agree to provide accurate information and to notify us promptly at support@competewithme.io if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content

Your content, your ownership. You own the content you submit — including photos, metric values, and competition data. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and process that content solely for the purpose of operating the Service on your behalf.

Photo submissions. Photos you upload as submission proof are shared with other members of the competition to which they belong. You are responsible for ensuring that any photos you upload are appropriate, truthful, and do not infringe on anyone else's rights.

Content you must not submit:

• Content that is false, misleading, or intended to deceive other competition members
• Sexually explicit material or content involving minors
• Content that is defamatory, harassing, threatening, or abusive
• Content that infringes on copyright, trademark, or other intellectual property rights
• Malicious code, spam, or automated submissions

We reserve the right to remove content that violates these Terms or that we determine, in our sole discretion, is harmful to other users or the Service.

6. Competition Conduct

Honest submissions. The integrity of Compete With Me depends on members submitting truthful data. Submitting false metric values or manipulated photos is a violation of these Terms and constitutes cheating. Competition members who are found to have cheated may have their submissions removed and their account suspended.

Respectful behaviour. Competitions are meant to be fun and friendly. Harassment, bullying, or intimidation of other members — through any feature of the app — is not tolerated.

Governance. Competitions use a consent-based governance model. Proposed changes require approval from competition members. Abusing the governance process (for example, by repeatedly proposing changes to frustrate other members) is a violation of these Terms.

7. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our infrastructure
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated bots, scripts, or tools to access or interact with the Service
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to manipulate competition outcomes
• Use the Service to harvest or collect personal information about other users

8. Intellectual Property

The Compete With Me name, logo, design, and all underlying software and content (excluding user-submitted content) are the intellectual property of Compete With Me and are protected by copyright and other applicable laws. You may not use our brand assets without prior written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it — it explains how we collect and use your information.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Results obtained through the Service will be accurate or reliable
• Any defects in the Service will be corrected

Compete With Me is a fitness and goal-tracking tool, not a substitute for professional medical, nutritional, or fitness advice. Always consult a qualified professional before making significant changes to your health or fitness routine.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Compete With Me and its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed $100 CAD.

12. Indemnification

You agree to defend, indemnify, and hold harmless Compete With Me from any claims, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your user content, or your violation of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date at the top of this page and notify you in the app or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
